Terms of service

The agreement

These terms are between you and Royal Bengal, 208 Mayfair Drive Northeast, Leesburg, Virginia, United States. By creating an account you accept them. If you are accepting on behalf of a company, you are confirming you are allowed to.

What the service is

MailPulse sends email on your behalf: campaigns you build in the dashboard, and transactional messages you send through the API. It sends from domains you have verified, through Amazon Simple Email Service.

Features described on the website as coming soon are not part of what you are paying for and may change or not arrive.

Your account

You are responsible for what happens under your account, including what anybody you invite does. Keep your password and your API keys to yourself. If a key is exposed, revoke it in the dashboard; you can do that yourself at any time.

One person belongs to one workspace. To join somebody else's workspace you have to leave your own first.

What you may and may not send

You may only send to people who asked to hear from you. The anti-spam policy sets out what that means and it forms part of these terms.

You may not send anything unlawful, anything designed to deceive the recipient about who sent it, malware, or anything that would put our sending reputation at risk. You may not use the service to send to lists you bought, rented or scraped.

We may suspend sending from your workspace without notice if your bounce or complaint rate threatens delivery for other customers or for the platform as a whole. We will tell you why and what to fix.

Plans, credit and payment

Plans are billed in advance through Stripe. Your plan sets how many emails you may send in a month and how many domains, contacts and team members you may have.

Sending is paid for from a credit balance. Credit granted with your plan resets each month and does not carry over. Credit you purchase does not expire. Purchased credit is spent only after granted credit is used up.

A campaign reserves the credit for the whole send before it starts, so a send that cannot be paid for in full does not begin. Anything reserved and not spent is returned when the campaign finishes.

Prices can change. We will give you at least thirty days' notice by email before a change affects you, and you can cancel before it takes effect.

Your data and ours

Your contacts, your campaigns, your templates and your sending history are yours. We claim no ownership of them and we do not use them for anything other than running the service for you.

MailPulse itself, including the software and the brand, remains ours.

You can export your contacts and your engagement data at any time.

Availability

We work to keep the service running and we do not promise it will never be unavailable. There is no service level agreement attached to these terms. Email delivery depends on Amazon Web Services and on the receiving mail providers, and neither is under our control.

Ending it

You can close your workspace at any time from the dashboard. We do not refund unused time on a plan, and purchased credit is not refundable once bought.

We can end this agreement if you break these terms or the anti-spam policy, or if you do not pay. Where the breach is fixable we will say what to fix and give you a chance to fix it first.

Liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Beyond that, our total liability to you for anything arising out of this agreement is limited to what you paid us in the twelve months before the claim. We are not liable for lost profits, lost business, or lost or corrupted data beyond that amount.

Governing law

These terms are governed by the law of the Commonwealth of Virginia, United States, and its courts have exclusive jurisdiction over any dispute.

These terms took effect on 31 July 2026. We will tell account holders by email before a material change takes effect.
